The GSC are aimed at describing the procedures concerning distance selling of goods and services between FRIO ENTREPRISE and the Customer. They express all of the parties' obligations and rights. FRIO ENTREPRISE may be led to adapt or modify the present GSC at any time. The applicable GSC are the ones in effect on the day of the Customer's order.
2.1 General Information
The Customer must put in his order in accordance with the specifications appearing on the Site. Any order validated by the Customer will be considered as effective by FRIO ENTREPRISE only after acceptance by the Sogenactif Internet payment server. Through the intermediary of the Site, the Customer may receive delivery at home, or at the address of his choice.

To guarantee the security of transactions and prevent frauds against payment means on the Internet, FRIO ENTREPRISE reserves the right to verify the reliability of the information entered at the time of recording of the Customer's order. The prices of the Site's products are the ones indicated in euros, including all taxes, but excluding delivery expense. The prices of the products are the ones in effect at the time of recording of the order put in by the Customer. However, FRIO ENTREPRISE reserves the right to modify its sale prices at any time, before order taking.
The products and services presented on the site must be paid for at the time of ordering.
4.1 Payment procedures
Payment must be made by means of the "3D Secure" secure payment system offered by Segenactif, by bank card.
4.2 Lack of Payment
FRIO ENTREPRISE reserves the right to refuse to honour an order or to make a delivery emanating from a Customer who has not paid for a previous order, in total or in part, or with whom a payment dispute exists.
FRIO ENTREPRISE reserves the right to suspend or cancel any order and/or delivery, whatever the nature and execution status thereof may be:
- in case of non-payment of any amount due from the Customer,
- or in case of a payment incident.
4.3 Title retention clause
It is agreed that the merchandise delivered and invoiced to the customer remains the property of FRIO ENTREPRISE until complete payment of its price. Lack of payment may entail a demand for return of the merchandise. The above provisions do not constitute an obstacle, beginning with the time of delivery, to transfer to the Customer of the risks of loss or of deterioration of the products, as well as of the damage that they might cause.
5 - Availability and delivery of the products
The deliveries are made solely in metropolitan France and in Corsica. The delivery expenses are for the Customer's account and vary depending on the kind of order involved. They are indicated to the Customer at the time at which he checks on the availability of its product.
The availability is indicated at the time of consultation of the product by the Customer. In case of unavailability of the product ordered, the Customer will be informed of that fact as soon as possible and will be entitled to cancel his order. In case of an impossibility of exchange, FRIO ENTREPRISE reserves the right to cancel the order and to refund the amounts paid. FRIO ENTREPRISE may not be held liable for product unavailability, and the latter shall not create any right to payment of damages to the Customer.
5.3 Transfer of risks
The delivery is considered as made when the shipper makes the ordered merchandise available to the Customer. It takes the material form of signature of the delivery slip by the Customer. The product or products ordered travels or travel at the sender's risks. - by express parcel: a prepaid label will be addressed to the Customer via the post to request return of the said product(s) at our expense upon receipt of the complaint by a shipper.

6.2 Right of Withdrawal
Pursuant to articles L.121-20 et seq of the Code of Consumption, the Customer has a period of seven (7) days beginning with the time of delivery of his order to return any article that does not suit him, in the original packing, and to request reimbursement by FRIO ENTREPRISE for the product(s) ordered.

Return expenses connected with the Customer's withdrawal
A product or products sent back carriage due or for collection on delivery will be rejected by FRIO ENTREPRISE.
If the product(s) has or have been delivered by a shipper, it will come to the Customer's domicile by appointment to take back the product(s). In any event, the products returned must be in their original packing, unused, accompanied by proof of purchase as well as by all accessories there may be, unassembled, use notices and documentation. The reimbursement or exchange presupposes that the product has not been damaged by the Customer or that it is not returned incomplete. Reimbursement for the product(s) after return will be made as soon as possible, and at the latest within thirty days following the withdrawal.
7 - Guarantees and after-sale service
7.1 Definition of the guarantee
FRIO ENTREPRISE grants the Customer a national one-year guarantee, solely for the functional parts on the electrical devices. This guarantee does not cover labour and travel. The product is guaranteed if it is accompanied by its purchase invoice. The guarantee covers the products in their purchase configuration and if their serial number remains readable.
The guarantee is valid in metropolitan France.
7.2 Shortcoming at the time of unpacking
If a shortcoming appears at the time of unpacking preventing use of the product in its anticipated configuration, the Customer must address himself to FRIO ENTREPRISE within 72 business hours. The product will then be exchanged (excluding breakage at the time of assembly and missing accessories).
7.3 Exclusions from the guarantee
FRIO ENTREPRISE's guarantee does not apply
- In case of accidental physical damage. In particular, it does not cover deterioration and breakdowns resulting from improper installation, assembly or use of the product, from normal wear and tear, or from lack of maintenance,…
- In case of indirect damage, FRIO ENTREPRISE's guarantee bears only on the right to repair or replacement of the guaranteed product. The indirect damage resulting from the breakdown or the deterioration is therefore not covered by the guarantee.
- In case of use not conforming to the instructions contained in the use notice
FRIO ENTREPRISE shall not incur any liability for any damage or indirect costs, or for any losses, and particularly loss of data or of information, and for any damage or expenses resulting from the use or the impossibility of use of the product by the Customer.
9 - Force majeure
FRIO ENTREPRISE may not be held liable for non-execution of the contract concluded due to the occurrence of an event of force majeure.
One is to consider as acts of God or as events of force majeure excluding liability any facts or circumstances that are irresistible, unpredictable and beyond the parties' control.
10 - Personal data
Within the framework of your commercial relationship with FRIO ENTREPRISE company, we are led to ask you to provide a certain amount of personal information. We inform you if the said information is mandatory or optional.
It is used only for processing your order or your request (sending for our newsletter, participation in the game, and commercial requests, etc.) and for personalised communication and the product offerings on the site, and in our information letters.
11 - Applicable law - Disputes
The present GSC are subject to French law. In case of a dispute, the French Courts shall hold sole jurisdiction.
